The State's and the IRS

The laws about child support are a tricky set of laws that few people understand.And like many parents I only understand the effects of what The State's do to the paying parent. There are lots of reasons people fall behind on child support and your STATE does not care. Injury, illness, lay offs, corporate down sizing, and even the mother not coming forward for years and boom one day as a parent you find yourself 3 years behind. LIFE and the State have very little in common. At the Court House steps you become a villain, The State pays the attorneys to hate you and the judge to only see the children, not the facts. Most of the laws by design were thought up FOR THE KIDS but the fact is 100 family's create 100 lives different from each other. 

Injured at Work

A friend got in an accident at work, he broke his leg. Of course the Workers Compensation part of being an employee was immediately notified. But they are allowed to drag their feet and do as they wish. He had surgery and then was sent home to recover. Not a lazy man and had worked and supported his children all along. Month one went by and recovery was not going as planned. He needed an additional surgery to repair some veins. Workers Comp waiting for a return to work date did NOT issue paychecks and he fell behind on child support. With a CDL and driving truck his only work, he was stuck. The division of Child Support took his Drivers License. He was off work 11 weeks and when the Dr released him to work he was fired for no license. 

LIENS

The State put liens on semi-trucks. So the owner could not license them, so they could not work to make an income. Ready to work contracts in place and the trucks couldn't move. An appeal was filed and 8 weeks later a court date. The owner took the Titles of the trucks he could not use and told the judge, TAKE THESE TITLES and apply the value to my support. IF I can't work because of your liens reduce my child support to ZERO. The judge released the liens but no credit was issued for the months the trucks or driver could not work. 

$55 a month to support a child. 

My husband was an asphalt construction worker. The State of WA required him to be paid Union Scale which at the time was around $28 an hour. So when we divorced he was to pay $480 a month but him and I agreed to $280, because of course some months he was on unemployment. His unemployment was max at 300 to 400 per week. I received $280 till he re-married. During an unemployment period SHE processed the papers to reduce his child support. The judge set it at $55 a month. The State would not allow me a court date for a minimum of 35 months. What kind of rule is that? Makes no sense that he chose not to work dropping his child support but then returning to work I couldn't go to court and increase support. 

No Christmas gifts, no birthday gifts, no school shopping. YES my reasons to divorce were indeed valid. I divorced a puke. He never attended to any of our daughters needs.  

when the 3 years passed his wife had a day care. House payment, electric, and car payments were then a deduction leaving his income at minimum wage and his life style $50,000. My daughter was only worth $166 but step-mom drove a brand new CAMERO and they owned the house. 

CHILD SUPPORT and other kids

Many people have Children with more than one parent. This is not uncommon at all. and the other kids should starve. It is a sad fact that The State and The IRS do not care if ALL CHILDREN are provided for. The IRS will take Earned Income Credit for one child and send it to pay support for a different child. UNEMPLOYMENT IS REDUCED 50% for child support debt and no concern about feeding kids in the home. 

RICH people use these practices every day and no one thinks anything about it. 

YOU CAN PROTECT YOUR SELF AS WELL 

A Business Licence
If you have a home business no matter how small apply for an (EIN) Employer Identification Number. This will create you separating your business and deductions from your personal taxes. The part that helps you is you can not only deduct expenses, like travel and even GIFTS, but you can separate working capital it takes to run the business. My experience with this was very real. And tho my daughter suffered, my X husband gained LEGALLY over me. 

Corporation
The liens to equipment can be avoided by the fact that corporations are an INDEPENDENT ENTITY they can own buy sell transfer property. They have no children so support is not an issue. They issue PAYROLL so there is clear history of moneys, earned or lost that is separate from an X that hate you. And a state that won't protect you from the hate.Corporations cost about $200 to set up with the State. You can write your own Articles or you can have an attorney write them.


Trusts
The wealthy use trusts to protect themselves from many things. Trusts are really tricky with lots of laws, differences, and if's. I don't know anything about individual types of Trusts IF a trust is what you think you need I would recommend you find a Trust ONLY Attorney.

NONE of this KNOWLEDGE is to help anyone avoid child support. But the protection is available to use against the State not valuing both parents and an X that hates you. Do not avoid paying your fair share for your children. Take them school shopping, remember them at Christmas and birthdays. Attend their school events and respect their person.
